Duterte shocks the Opposition anew in appointing Teresita De Castro as Chief Justice

The bad news just keeps on coming for the Philippine Opposition. It has not been a good year for them. In fact, things haven’t been good for them since President Rodrigo Duterte won the election in 2016.

Members of the Opposition particularly those allied with the Liberal Party have tried every trick in the book to remove Duterte from office – from calls for people power revolution to filing of criminal charges against him before the International Criminal Court – but all they get in return for their efforts is disappointment. They can only moan helplessly and cry in outrage as the Duterte government turns their worst nightmares into reality.

Duterte certainly did not disappoint in disappointing the Opposition. It was like a walk in the park for him. The Opposition did not have a chance because, for one, the law was quite often on Duterte’s side and two, they base their arguments on emotion, not reason. Indeed, the Opposition’s arguments did not stand a chance in court.

The first time Duterte sent the Opposition spinning was when he allowed the burial of former President Ferdinand Marcos Sr at the Libingan ng mga Bayani or Heroes’ Cemetery. They tried in vain to stop it, but the Supreme Court ruled that the burial was not against the law. Weekly rallies did not move Duterte and his supporters. It was actually surprising they were surprised he allowed the burial considering that was one of his campaign promises. It is not surprising though that the Opposition did not file for a restraining order much earlier to stop it from happening. Former President BS Aquino did not even think about changing the rules at the Libingan ng mga Bayani to prevent a Marcos burial when he was still in office for six years. It was just another example of their lack of foresight.

The second time the Opposition got a rude shock was when Duterte declared Martial Law in Mindanao in response to clashes in Marawi City between the Philippine military and Maute/ISIS group hiding in the city. He justified the declaration as an essential one, “in order to suppress lawless violence and rebellion and for public safety.” But of course members of the Opposition went into panic mode and concluded he was using it as an excuse to declare Martial Law in the entire country and assume a dictatorship. Their attempt to put a restraining order also failed since the Supreme Court said that “the claims of violation of human rights are speculative and lack a nexus between the exercise of martial law powers and their apprehension of such violations” — meaning, the Opposition was imagining military violence against ordinary people. They were being irrational as usual.

Just when the Opposition thought things couldn’t get any worse, Duterte pulled another fast one. His solicitor general successfully removed Lourdes Sereno from the Chief Justice post through a Quo Warranto. Eight Supreme Court justices voted to nullify Sereno’s appointment. They found her disqualified and guilty of unlawfully holding the Chief Justice position due to her failure to submit all the required financial documents when she applied for the top judicial post in 2012. Her motion for consideration resulted in the same outcome. It’s quite baffling she expected the justices to change their decision considering she did not produce new evidence to support her claim that she did submit all her Statement of Asset, Liabilities and Net worth.

Fast-forward to today, one of the eight justices who voted against Sereno and considered to be her staunch critic Teresita De Castro has been appointed the new Chief Justice of the Supreme Court. Sereno’s supporters have been crucifying De Castro even before Sereno was removed, now they have gone all-out in saying her efforts to demonise Sereno has paid off. Never mind that De Castro is reportedly the most qualified justice for the position…

In 2012, then Associate Justice and now Chief Justice De Castro was the only CJ applicant who obtained a grade. of “1” in the psychiatric and psychological tests. “1” is the highest score in the 1-5 range in the 11-page JBC Psychiatric and Psychological Report

They still can’t accept that Sereno’s appointment was void from the beginning. They are still in denial even after the motion for consideration was denied. Sereno’s illegitimate appointment was BS Aquino’s legacy. It is now on record he did not do his due diligence in choosing the Chief Justice. It is another blow to his ego.

But with De Castro retiring in two months when she turns 70 years old in October, it seems her appointment as Chief Justice is more symbolic than anything else. It is Duterte flicking the middle finger on Sereno and the rest of the Opposition. Since his move is above board, all they can do is cry and gnash their teeth in despair. That’s what happens to people who think they are above the law. They should try sticking to the rules and perhaps then, they will have a chance to win the battle next time. But I doubt it. The next round will put the final nail in the coffin – the removal of Leni Robredo as Vice President once the allegation of electoral fraud is proven. Most of us already know the law is not on their side especially now with De Castro as Supreme Court Chief Justice.

  1. Leni Robredo, the fake Vice President was placed in that position, to ensure that the Aquino Cojuangco political axis hold in power will continue. Even if Pres. Duterte wins the election, they are in force, to impeach him in anyway they can.

    At the onset of the Duterte administration, they are already preparing for the Impeachment procedures, in the Senate. The crook and drug dealer, Leila de Lima, and the “assault dog” of Pnoy Aquino, Trililing Trillanes, were working in tandem for the outright impeachment of Diggong Duterte.

    It is fortunate, that Duterte, has many years of experience in politics. All the forces of the opposition are arrayed against him. From the asking of help from the European Union; to the filling of criminal charges in the International Criminal Court; to the asking of help from the U.S./C.I.A.;to the Trilililing Truillanes lobbying to U.S. Sen. Marco Rubio. Now, Bam Aquino, the Bobo, went to the Roman Catholic Church Pope, to ask for help in removing Pres. Duterte.

    Nothing worked on Duterte. He is just a tough guy, to be removed. So, they are hoping that Duterte will drop dead. The fake Vice President Leni Robredo, might become President; and continue to their hold of power by hook or by crook.

    The Leni Robredo, cheating in election, was done, thru former COMELEC Chief Andres Bautista, being paid a lot of money – multi billion pesos of our own tax money; deposited in many bank accounts here and abroad. Now, the crook , Andres Bautista, is enjoying his loot in the U.S.

    We should abolish the COMELEC. Remove the SMARTMATIC HOCUS PCOS. It has not given us anything good. It facilitated electronic cheating, by those who control COMELEC.

    The trouble with the opposition is: they have no political platform. No plan or vision , for us and the country. They just want to be in power. And continue their corrupt and crooked ways.

    Shock them, Diggong, until their eyeballs will fall out from their eye sockets !

  2. Remove all facilities in the government that the Aquino Cojuangco political axis has left in the government. Caguioa and Sereno, are the ones. It is good that Sereno, was a victim of Qou Warranto.

    Ombudsman Carpio Morales was one; along with Carandang. They are the facilitators of Selective Justice. Carpio Morales recently retired. Carandang was kicked out.

    The Bias Media of all kinds, are another. They give Fake News and are sources of disinformations. Some of the politicians in Congress and Senate are “black and white” in loyalties. They go where the power go…so are those in the local government.

    Mar Roxas, not only stole the Typhoon Yolanda Fund. He left a strong infrastructure of Shabu and other drug dealers to the Baranagay root level, to continue the drug trade with the crook and drug dealer , Leila de Lima and her cahoots.

    Pnoy Aquino, the clueless idiot, is there watching and waiting for his Fake Vice President, Leni Robredo, to become President.

    Recently, they brought out the issue of the health of Diggong Duterte.

  3. Really?! What is so shocking with that? Opposition knew that this administration has that principle of “utang na loob/debt of gratitude” since the start of Duterte’s term. De castro’s appointment is just a price she won after ousting Sereno. It is expected and predictable of this administration. No need for brain cells. It is ironic they keep harping about “change is coming” and “the best and the brightest” and yet they don’t stick to that principle. So where is the change and the best? You have Uson and Montano for example, as “pambayad utang na loob” and many others in his incompetent cabinet/staff circle.

    Indeed, Duterte is no different with the traditional politicians who exhibited “utang na loob” “padrino system” “nepotism” “cronyism” “narcissistic disorder” and things of similar nature in his administration, which are the reasons the Philippines remains to be backward, dysfunctional and third world. And which the author highlighted in her many articles before Duterte’s presidency of what is wrong with the Philippines and yet failed to correct Duterte on that but even yet is encouraging Duterte to follow. Hypocrite much with your supposed excellent standards as opposed to Aquino’s presidency.

Marcos controlled those things you’ve mentioned and in case you don’t notice, they are sooooo close on defeating the NPA in the 80s, according to the late Father Conrado Balweg a.k.a. the Rebel Priest. If anything, it was Cory who should be blamed because the freeing of Joma Sison and other members of the CPP until moving to the Netherlands in exile makes the NPA still at large. According to Balweg na ‘malapit na silang bumagsak sa panahon ni Marcos and it was only the Cordillera group who saved the situation. In the Cory administration, lumakas ang NPA dahil pinalakas ng gobyerno (freeing of Joma Sison and other CPP leaders).’ In his final analysis, Balweg states that although the President is the Commander-in-Chief, it was the strength of the military that is vital in defeating the NPA along with full support of the people.           The 1987 Constitution allows a very flawed government it even allowed celebrities and last names to go into politics and that’s why we never had truly efficient leaders. So it’s not the ‘best’ the people elected but only those who are popular. Back in 2010, we had a chance with Richard Gordon but nope, it’s Noynoy thanks to necropolitics.

          And about its archaic economic system, we have a protectionist economy. 60/40 clause. That means only Filipino businessmen have the right to build small businesses w/ no foreign intervention. But there is monopoly in middle class. So it only serves the Filipino elite instead. Only around 40 families control the bulk of Philippine wealth, monopolizing vast swathes of land and public utilities, raising prices unnecessarily and barely making a dent in alleviating poverty.

          So in turn, the 1987 Constitution had policies that allowed Cory and her personal cronies do their thing LEGITIMATELY that it made the country regressed for years while the rest of them getting kickbacks. In other words, through the 1987 Constitution, the Aquino-Cojuangco clan and their oligarch friends robbed the public BLIND for 30 years! So it wasn’t the Filipino people who drafted it.         1. I don’t really have a bucket list before my demise, but I can say robbing a bank isn’t one of them, lest I sully my “good name” I have been carrying for my entire lifetime. I don’t really have nation-changing achievements in my life, but I could at least keep it clean.

          One thing that probably sounds nice to leave behind would be children, expand your genes and your legacy. With that, your 24/7 fling might sound alright, but then again all those children without a father to support them isn’t so great.

          At the very least, if you’re an artisan of any kind or if you’ve got a hobby, it’s probably best you make your magnum opus during your final days. Perhaps you leave something behind to your next of kin, money or property.

While it may seem that this gesture of PRRD to grant the most qualified person in land the top seat of Chief Justice (though practically just titular in nature – considering the remaining time she has left), it represents a significant shift in the nature of appointing officials in this country.

      The move was more than anything else an emphatic public statement by the president:
      “Singapore-class Meritocracy IN; Yellow Noynoying-around Incompetence OUT”

      And if people still did’t get the memo, there’s the position of “fake VP” at the current government’s disposal which it can effectively use as an instrument for adding a more unmistakably visible exclamation mark.

        The Law is just a sort of technology, and if you don’t understand how it works, you won’t be able to apply it. I’ve noticed most Filipinos don’t “get” what the Law is. Even a lot of lawyers don’t.

        Take contracts, for example. A contract is nothing more than a written promise between two parties: I’ll do this and you’ll do that. It’s underlying purpose is to create a win-win situation for both parties.

        To that end, a contract must be very carefully worded so that each party knows what they have to do to produce the right outcome and avoid misunderstandings/trouble. Not in the Philippines. Here, it’s just a magic document that has magic-dust sprinkled on it by lawyers. It doesn’t matter what the words say. In fact the more incomprehensible they are, the better. As long as it has the right magic-dust, it does magic things (nature unspecified). The parties to the contract duly sign, hand over money to the lawyer … and then proceed to screw each other over. Because by and large, Filipinos don’t know what a “win-win” arrangement even is, so the idea of a contract is subverted right from the get-go.

        The whole of the Law here is like that. It’s like those cardboard-cutout movie sets in old Westerns: it has the right superficial appearance, but if you look around the back, it’s all just string and plywood. Teresita De Castro’s job is very simple: don’t rock the boat, spout some high-falutin’ nonsense occasionally, and draw a large salary. Justice doesn’t come into the equation.
