Take the case of Senator Leila De Lima. One would consider De Lima’s Senate hearing on the alleged drug related “extra-judicial killings” under the current administration of President Rodrigo Duterte laudable if it wasn’t highlighting her failure in her previous jobs as Chairperson of the Human Rights Commission and as Department of Justice Secretary respectively.

Her Senate hearings are supposed to result in finding out if there is truth in the perception that the murders are due to abuse of power by the members of the Philippine National Police. Unfortunately, De Lima’s witnesses are not helping shed light on it. Her first witness proved that it was during former President BS Aquino’s term when her husband and father-in-law were allegedly dealing with corrupt cops who were involved in drug dealing. Now her latest witness only divulged information not relevant to the issue she is currently investigating.

De Lima’s latest witness, Edgar Matobato, alleged former member of the Davao Death Squad, revealed damning information about President Duterte and his son Paolo Duterte. According to Motubato, he has killed 50 persons personally between 1988 to 2013 and only killed them as per instructions of Duterte and his son. He also accused Paolo of being a drug addict who took part in the killings. Furthermore, he claims that Duterte ordered the Davao Death Squads to murder De Lima while she was in Davao City back in 2009 investigating Duterte’s involvement in the killings.

 Matubato said he was a militiaman under the Scout Rangers when he was personally recruited by Duterte in 1988 to join the “Lambada Boys,” a seven-man “liquidation squad” he said was the precursor of the DDS.

The Lambada Boys, he said, was sent out to kill “criminals — pushers, rapists, snatchers every day.”

“Ang trabaho lang po namin Ma’am, pumatay lang nang pumatay ng tao (Our only job was to kill and kill people),” he told Senator Leila De Lima.

Matubato said he and several DDS members were ordered, allegedly by Duterte, to ambush De Lima and her party and had positioned themselves on the hilly portion of the quarry. However, the attack was not carried out because De Lima said, “hindi na kami umabot doon (we did not reach that far).”

Matobato’s account, if true, is shocking, indeed. But what is even more shocking is the fact that De Lima presumably knew about all this information years ago because Matubato was under their witness protection program. Yet she didn’t do anything about it. One wonders why De Lima did not file a case against Duterte before he ran for President. De Lima was DOJ Secretary for 6 years but couldn’t produce a credible witness against Duterte. Now that she is under fire for her failure to stop the drug trade in the country’s penitentiary, the New Bilibid Prison and her own alleged involvement in the drug trade, all of a sudden she produced a witness who remembers every victim Duterte supposedly ordered killed.

It seems De Lima is trying to pin Duterte for something that he cannot be prosecuted for because, one, the alleged crimes were committed while he was still a mayor and, two, Duterte enjoys immunity from suit while he is President. The bottom line is, De Lima is wasting everyone’s time with information that is not needed in the hearing. Therefore, we can conclude that De Lima’s goal in inviting her witness is to engage in character assassination – something that she was against when Duterte divulge her affair with her driver.

Some people couldn’t help but notice that both De Lima and Senator Trillanes were asking the witness leading questions. Both senators also tried to stop Sentor Senator Alan Peter Cayetano from cross examining the witness. They wanted to limit his questioning time. Both De Lima & Trillanes seemed afraid the witness might implicate the Liberal Party in the plot to unseat Duterte. Cayetano insists that the hearing has turned into a demolition job against Duterte instead of a mere investigation on the extrajudicial killings.

Senators allied with the Liberal Party have used senate hearings in the past as a platform to persecute their political enemies. They know both the local and international media are watching and are using the opportunity to tear down Duterte’s reputation. They have done this several times in the past. They do not care about the repercussions in doing this. If investors lose trust in the Duterte administration, the economy might suffer and so will the Filipino people.

The members of the Liberal Party will not hesitate to damage the reputation of their enemies even if it means damaging the very fibre of Philippine society. Despite their façade of decency, the Liberal Party is not championing due process. If they were, they would also want to know if the witness is telling the truth. It seems they just want to grab power back by riling up the public and turning them against Duterte. Fortunately, a lot of people can see through what they are doing since they have done this to others so many times in the past. The pattern of their sociopathic behaviour is now too obvious. Only the gullible will believe them.

  21. I’m one of those persons who finds the timing of this whole senate hearings very fishy. Matobato was supposedly in the witness protection program of the DOJ since Duterte was still a Mayor. I’m also pretty sure that Matobato is not the only witness that the DOJ and the CHR have in connection with the Davao Death Squad. So why didn’t they use them to smear the campaign of Duterte?

    My theory is that, these witnesses were ready to be presented to the public during the campaign period. If the Ruling party (LP) had enough time, they would have, but sadly, they were too busy dealing with Binay and Poe to notice Duterte. Then Trillanes started his smear campaign against Duterte with the BPI account affair, and the reaction of the people to this campaign probably scared the LP because, for the first time, they realized just how monstrous Duterte’s popularity really was. They must have thought that a Duterte presidency was a real possibility.

    They thought even that if they presented the Matobato and the other witnesses then, and actually filed criminal cases against Duterte, he would still win the elections. In effect, the people whould have “condoned” the killings by electing Duterte, and impeaching a President over something that the voters have already “condoned” would be political suicide to the would-be Senator-Judges. So, they let the issue lie low, and prepared to unleash this “bombshell”, true-or-not, if Duterte does indeed get elected. Then the Ruling Party and allied Media can continue to pound on this issue, repeat it and repeat it until it becomes the “truth” and nobody would mind another impeachment/ICC case against the President.

    Timing is everything.

    It didn’t matter that Matobato’s testimony was full of loopholes. De Lima just needed someone who would make outrageous accusations against Duterte on live TV at the senate hall, so the foreign media would have new material for anti-Duterte stories.

    The yellows and their foreign backers are now focusing on international media because they know the local media has been overwhelmed by Duterte’s popularity.

    The constant negative propaganda on foreign media is meant to rattle investors and tourists, and demoralize people who support Duterte.

    It is also meant to stir up a global clamor for Duterte to be charged at the ICC (International Criminal Court) and forced to vacate his post. The Duterte government should not let the UN do an “independent” investigation like they’ve been lobbying. That is a trap. That investigation will be anything but independent.

    How should this be countered?

    1. Duterte’s team should exert more effort to communicate positive news about the Philippines to foreign audiences, especially on business and economic reforms, and ensure this positive news gets global coverage on both traditional and social media.

    2. There should also be a lot of news showing Duterte at his best, to humanize his image and reassure foreign audiences that he is not the barbarian the media are portraying him to be.

    3. Livestreaming of Senate and House hearings should have on-the-spot English translation and subtitling. Clips of the most important parts should be made publicly available as soon as possible after the hearings.

    4. The accusations about death squads and killings can be addressed by putting up a website that debunks false reports on Duterte, and airs his side on these accusations which the traditional media are not showing. Duterte’s communications team should not dwell too much on these issues because constantly talking about them will only extend their run. Just refer people to the website whenever they ask. It can even be an unofficial (but credible) website run by Duterte supporters with the right professional background.

    Matobato is just the flavor of the week. These attacks will keep coming, and they will get worse. Duterte’s communications team needs to set up the right infrastructure and protocol for squelching these attacks quickly each time they come.

    After a while, even foreign audiences will get tired of the black propaganda and the international media will also end up where the local media are now when it comes to their biased Duterte reports—with credibility in tatters.

    People are smart now. They can see what’s true and what’s not, and they are not easily influenced even by international media. In fact, I notice most Pinoys are not affected by what the local and foreign media are saying about Duterte. They are more bothered by the weakness of Duterte’s communications team.

    I think the reason why the other Cabinet secretaries are jumping in to defend Duterte even on issues that don’t involve their departments is because they see how inadequate Ernie Abella is. I’m sure Abella is working hard, and he is a good person who is skilled in other areas, but he simply isn’t right for the job of presidential spokesperson. For example, this was his response when the press asked him about Matobato’s accusations:

    “I believe, as in all cases, all citizens should maintain a sense of sobriety and maintain a sense of objectivity . . . After all people do make statements every day. And while this person may sound credible, it is imperative that each and everyone of us properly weigh whatever is said.”

    This response was too long, full of extraneous “filler” words which is Abella’s usual way of speaking, and there is no single coherent thought. He even unthinkingly said “while this person may sound credible . . .” while he was coming up with his filler statements.

    Abella doesn’t know how to speak in soundbites. He doesn’t have the strategic thinking ability to quickly analyze events as they unfold and figure out which angle to focus on, then formulate one clear, targeted statement. He doesn’t have the presence of mind to react quickly yet compose his words carefully.

    I mean no offense, but President Duterte is better off having no spokesperson than having Abella as a spokesperson. The other Cabinet secretaries that the PCO is asking to pipe down are actually doing a better job at getting the right messages out. They’re just not coordinated, hence the contradictions, but they are focusing on the right points, and they think and move much more quickly than the official spokesperson. People close to the president really need to figure this out, because this propaganda war will not be won with the current communications setup.

Was the testimony of the witness/killer true? Based on the confession, the events he recalled and his narration of numerous details where, what, who and at times the execution itself is graphic enough that a mere watcher like me have no reason to believe that the witness is lying in all of those things.

    I cannot with conviction say that the witness invented a story to sell on the Senate floor.

  29. senate president koko pimentel said that the hearing was off topic and it just wasted the day. the hearing didn’t contribute to the proposed senate resolution no. 9 as the witness was talking about EJK from 1988 to 2013 and 2013 it seems the witness was no longer part of. pimentel said personally it was off topic. pimentel also said, “it seems that all murders can be blamed to one person.”

    Pimentel also was sad about the attitude in the house. “you don’t take the law into your own hands like turning off the mic of your fellow senator. don’t taunt and don’t heckle your fellow senator.”
