Allan Bantiles: Parent who allegedly threatened CSA student at gunpoint still at large

Colegio de San Agustin (CSA) student Jaime Garcia who was the alleged victim of a serious bullying and assault incident within the CSA campus has been seeking assistance from the Philippine Media to progress his cause versus his tormentors. Garcia’s grandmother, Sony Lopez Gonzales, started by bringing the matter to the attention of ABS-CBN personality Korina Sanchez in a dzMM radio program in mid September this year. The interview was reported on ABS-CBN News which related how Jaime Garcia had been harassed on campus for weeks before he finally lost his temper and hit back, injuring one of the alleged bullies.

A more recent account provided by Garcia himself while being interviewed on TV5’s Good Morning Club and reported on Interaksyon.com shed more light on the incident. It was the alleged leader of the bullying group who Garcia referred to as ‘JD’ and another classmate from that group that were on the receiving end of Garcia’s striking back. But it was JD’s father, Allan Canete Bantiles, that Garcia alleges threatened him with a gun following the incident.

“[Bantiles] asked me if I was the guy who hit his son [‘JD’]. I apologized. In thought he was a reasonable guy,” Jamie [Garcia] said.

“He slapped me. He told me never to do that again. He told me, ‘You’re crazy. You deserve to be in a mental institution.’ I still apologized.”

According to Jamie, Bantiles wasn’t content and grabbed him, while saying : ‘You want to fight? You want to go outside now?’

Bantiles’ driver and son were in the room when the situation escalated. The fuming Bantiles asked for his “green denim satchel’, Jamie recalled, and brought out a gun.

“He then said:’ I can shoot you right now! You want me to shoot you?’” Jamie said.

The key question being raised in light of the way CSA and the police handled this incident is quite pointed:

Why wasn’t the police called and Bantiles arrested on the spot or (if no longer at the crime scene) hunted down?

According to reports, Bantiles was allowed to go free following the incident and is reportedly currently in hiding. The Interaksyon.com report noted that the CSA Makati Alumni Association (CSAMAA) for its part merely lodged a “case report” with the Department of Education citing some “actions” taken presumably to demonstrate that measures have been put in place following the incident including…

(1) “increased security on campus”;

(2) “banning of Bantiles [from the CSA campus] ‘indefinitely’”; and,

(3) “creating an Anti-Bullying Committee.”

Garcia’s father Mike told Interaksyon.com that they sought the assistance of the media after he felt dissatisfaction over these “actions”. The Facebook page Allan Canete Bantiles: The Gun-Toting Man at Colegio San Agustin has since been created to denounce Bantiles’s alleged actions and keep track of progress in taking him to task for these. As of this writing, the page has attracted 1,060 subscribers. Social media “activists” are also on the ball posting various factoids supposedly relevant to the case. On Twitter, a certain Erika Saenz even tweeted what seem to be the model and serial number of weapons registered under Bantiles’s name, a Glock – 9mm with serial number AAAC680 and a Colt .45 with serial number FC 27739.

Is pointing a gun to and making threats against another person a bad thing in the Philippines? You’d think so. Article 282 of the Revised Penal Code of the Philippines states;

Any person who shall threaten another with the infliction upon the person, honor or property of the latter or of his family of any wrong amounting to a crime, shall suffer [the] penalty next lower in degree than that prescribed by law for the crime be threatened to commit.

In this case, the applicable criminal act seems to be that of frustrated homicide described over Articles 249 and 250…

Art. 249. Homicide. — Any person who […] shall kill another without the attendance of any of the circumstances enumerated in the next preceding article, shall be deemed guilty of homicide and be punished by reclusion temporal.

Art. 250. Penalty for frustrated parricide, murder or homicide. — The courts, in view of the facts of the case, may impose upon the person guilty of the frustrated crime of parricide, murder or homicide, defined and penalized in the preceding articles, a penalty lower by one degree than that which should be imposed under the provision of Article 50.

The courts, considering the facts of the case, may likewise reduce by one degree the penalty which under Article 51 should be imposed for an attempt to commit any of such crimes.

Bantiles’s alleged gun-pointing incident which supposedly occured back on the 30th of August is now almost a month old. Yet as of this writing, Bantiles remains at large and the Philippine National Police reports that no charges have as of yet been filed against him.

    First of all, if the police do not have personal knowledge of the events that happened, they have no right to arrest nor pursue Bantiles. They have to get a warrant for that. And for that to happen a complaint has to be filed at the Prosecutor’s office, for a determination of probable cause so that an information could be filed in court. Only then could a Judge issue a warrant of arrest upon a judicial determination of probable cause.

    Second, there is no frustrated homicide here, check article 6 of the revised penal code for the elements of a frustrated felony. If I were the Fiscal, I’d file a case of Grave threat with the threat being a threat of MURDER the qualifying circumstance being the victim’s age.

  2. In America this thug would have left the school in an ambulance, most likely headed for the County Morgue. There are police officers in our schools just because of crap like this. No need to wonder where his son learned to be a bully is there?

      I agree with you that the complaint should have been filed or a blotter of the incident should have been made.

      I am wondering why the parents of the kid did not do so as well. But to just go out and blatantly push for a mano-y-mano fight to finish is quite childish.

      Why do you need to go there anyway? To show you have the balls to man up to a guy who could bring a gun to fist fight? That’s it? PRIDE?

      What bugs me about the incident is CSA and the parents inaction on the incident in terms of filing a case with the cops.

      It needed to go to the media before such a thing was even being considered for a more proper course of action? And just plainly banning him from the school grounds? That’s it? How connected is the guy with the CSA that they can’t seem to lift a finger. Something seems to be up.

      I also don’t know why the parents don’t file a case or didn’t file a case then and there and request from the authorities an appropriate response as detaining him etc etc. They have witnesses, have them signed affidavits under the school and the case should be closed.

      Since it is also a private school, I would assume there is some form of CCTV footage at least on certain parts (hopefully) to further support the case.

      But recommending to just shoot the guy when you meet him, what age do you live in?

          Yes, you may be living in the modern age, but apparently it doesn’t appear you are trying to approach it civilly.

          Self Defense does not apply if you are the one who went after someone you feel “threatened by”.

          I am being rational because he is not chasing me with a gun as you say but he has done something illegal which both the school and the parents should have taken IMMEDIATE ACTION, which does not resort to something immediately physical (as handcuffing him for detention may end up getting physical later on) and legal (not resorting to murder and causing some sort of “blood feud”).

          It is a different case when you are implying that he is actively trying to chase and gun me down at the “present time”. Is he? And let’s say he does while you are taking a pro-active and proper course of action, then he is digging his own grave and making it deeper. At least this shows the people (not only my family) that violence is not the answer.

          You do not believe the same so I leave it at that, but I think what you are saying is actually illegal and immoral so I had to make a stand and counter your mindset.

    The entire school is a bunch of WIMPS!!! They didn’t deal with the incident!! DISGUSTING – BOTH BANTILES AND SAN AGUSTIN!

    There is a law against gun toting and it is disgusting to find out that he was not arrested on sight! The school security should have arrested him. When you pull out your pistol, you have to fire it because if you don’t, its gun toting and you can still be jailed for it! San Agustin’s security are a bunch of wimps! They should have dealt with it immediately. The school is answerable as well for not dealing with the incident and they oughta be sued as well.

  5. This gun-pointing incident is a sad indictment on Colegio de San Augustin, the Philippine Police force, and the perpetrators of the bullying and gun-pointing.

    Firstly, the bullying…., it is sexual assault by an obvious homo-sexual, J.D., not being discriminatory, but how could CSA allow such bullying and sexual assault to go on for over 2 months? and then they punish the victim (Garcia) with a 3-day suspension for his final “self-defence” ? What do they expect the kid to do? Ok, he should have reported the bullying when if first occurred, but CSA clearly doesn’t have a system set-up to encourage such reporting, just suffering of countless children to homo-sexual assault on their premises.

    Secondly, as Hyden Toro says, how was the gun allowed into the school? Clearly security has severely lacking or no proper procedures. In practice, the parents of CSA are most concerned about kidnapping occuring outside the school, and nobody has put much thought into threats on the lives of students inside the school, so therefore security against this is not planned for. CSA needs to get real, and put in an X-Ray machine for all bags coming onto the premises, and a metal detector for people, and set-up some lockers for the storage of bags, guns, knives, and other items that shouldn’t be allowed onto school premises. They also needs some security guards with basic intelligence, skills and procedures to follow, and the will to stand up to self-proclaimed “big-shots” like Bantiles, with the money and guns to be a problem in society. For sure CSA can afford to set this up, and I wonder when all the other “rich” parents will demand that they do this….. GET-REAL CSA!

    And the Police, well both Kyko and Ronnie are right, the police can go an question anyone anytime, and often do but for the wrong reasons, i.e. to extort money, and usually they will wait to be paid to pursue a matter, which is a sad fact about them not being paid a decent wage to live on, so they have to get income from somewhere, which is the general public. In order for due process to be followed, and warrants to be issued etc., official complaints and reports do need to be filed, however it is done now, and still no action or arrest, so what the hell are they doing? Perhaps they’ve been paid by Bantiles to leave him alone??

    About CCTV footage, you are right 17Sphynx17 but the sad fact about that, is they probably went “cheap” on the procurement of cameras (or someone pocketed too much of a kickback), and the ones installed are too low-grade to be able to use the images as evidence in court. The perpetrator (or his bodyguards) may have sequestered the footage or forced the erasure of it from the hard-drives, or even sadder, they didn’t procure enough hard-drive storage capacity for more than 7 days worth of footage so it has been over-written by now, something that CSA would have known about when not filing a report for over 2 weeks.

    Finally, Ronnie does also have some points, with respect to the ability of kids to defend themselves, and if the victim had been trained in some martial arts, like Taekwondo, Karate, Kung-fu or even better Filipino Arnis, probably he would not have been bullied in the first place, or if he had, he would have stood up for himself at the first incident, and when the gun-toting Bantiles came storming onto campus, the victim would have had the capability to disarm Bantiles, and maybe let him face his own medicine.

    Wondering what corrective actions CSA will pro-actively take, and what will be pushed on them by parents of children who might just pull their kids out en-mass and shift them to other schools better equipped to ensure gun-toting idiots can’t enter their premises and potentially rip-off a few rounds, and kill their innocent by-standing children. I would have already pulled my kids out of that school by now!

      I think I have the answer as to how he can’t just pull out his son from CSA. It is not yet the progression to the 2nd semester, as such a transfer is not as easy.

      Second, by just pulling out his son, he may be blowing it our of proportion as the school has at least guaranteed his son’s safety to a certain degree. Pulling out his son also may cause his son to get lagged behind in his grades and actually not “learn”.

      I actually don’t know whether I would’ve stopped him from completely going to school (for my son) but I would consider giving him a week or two off to calm down from the intensity of the events.

      I would move him the soonest I can that makes it proper not only as a course of action, but in a way that his efforts in school is not wasted or questioned.

    In any case, I was “officially withdrawn.” Not sure what happened to the other kid. But my parents later told me that the entire matter was to be hushed over to avoid lawsuits.
